1. About these terms
These terms apply when you use cadencemsp.com, take the free Cadence Maturity Score, or book a call with Cadence (“Cadence”, “we”, “us”). By using the website you agree to them. If you do not agree, please do not use the website.
2. Our programs are covered by a separate agreement
The Cadence Bootcamp, the Cadence monthly program, workshops and the Cadence Ops Center are provided under a written agreement or order form with you. That agreement sets out the scope, fees, payment terms, term and renewal. If it conflicts with these terms, the agreement applies.
Descriptions of programs on this website are summaries only, and details such as dates, formats and topics can change.
3. Information only, no guarantee of results
The website, the Cadence Maturity Score and our materials are general business information, not legal, tax, accounting, financial or investment advice. Results depend on many factors, including your effort, team, market and starting point, and we cannot promise any particular outcome. Any guarantee we offer is available only on the written terms of the agreement that contains it, and any description on the website is subject to those terms.
4. The Cadence Maturity Score
The score is an assessment tool based on the answers you give. It is meant to help you see where to focus, not to value your business or predict results. Its accuracy depends on the information you provide. We may update how the score is calculated.
5. The Cadence Ops Center
Access to the Cadence Ops Center is provided to clients for their internal business use for the period covered by their agreement. You are responsible for the accuracy of the data you load and for keeping login details confidential. Access after your program ends, data export and any service levels are as set out in your agreement.
6. Intellectual property
The website, program materials, templates, scores, dashboards and software are owned by Cadence or its licensors and are protected by copyright and other laws. We grant clients a limited, non-transferable licence to use program materials for their own internal business use. You may not copy, resell, share or publish them outside your organisation without our written permission. Names and marks of other companies belong to their owners.
7. Your information
How we handle personal information is described in our Privacy Policy. Business data you share with us in a program is treated as confidential and used to deliver services to you, as set out in your agreement. We may use de-identified, aggregated data, which cannot identify you or your company, to improve our programs and benchmarks.
8. Fees and payment
Fees, payment schedules, including any installment option, and refund or cancellation terms are set out in your agreement or order form. Prices shown on the website are for general information and may change. Unless stated otherwise, prices are in US dollars and do not include applicable taxes.
9. Acceptable use
Please do not misuse the website, try to gain unauthorised access, interfere with its operation, submit false or misleading information, or use it to harm others.
10. Links and third parties
The website may link to third-party services, such as scheduling tools. We are not responsible for their content or practices, and their own terms and privacy policies apply.
11. Disclaimers
The website and its content are provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.
12. Limitation of liability
To the extent the law allows, Cadence is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the website. Nothing here limits liability that cannot be limited by law. Liability under a program agreement is governed by that agreement.
13. Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware. If you use the website from outside the US, you are responsible for following local laws that apply to you.
14. Changes
We may update these terms from time to time. The date at the top shows when they were last changed. Continuing to use the website after an update means you accept the new terms.
